Toyota Enters Out Of Settlement Over Acceleration Mishaps

Toyota was alleged of incompetency when the Lexus sedan driven by a Californian family sped out of control and crashed. The accident which occurred in August 2009 near San Diego highlighted the sudden acceleration problems with the automobile bringing in a nation wide response. This incident prompted a recall of millions of vehicles.

Reports suggest that Toyota has entered into an out of court settlement with relatives of the victimized family. The company has been reported to confirm the settlement on Saturday in a statement though specifics regarding the amount were not provided. The settlement resolves product liability claims made by the victims-the Saylor and Lastrella families against Toyota and the dealership. Prior to the crash a back-seat passenger called up 911 to report that the car’s pedal was stuck and that the driver, an off-duty California Highway Patrol officer named Mark Saylor, was unable to stop the 2009 Lexus E350, which went as fast as 120 miles per hour before hitting another vehicle. Ultimately two months later Toyota began a recall covering 5.4 million vehicles globally where the driver-side floor mat could trap the accelerator pedal. Toyota was charged a fine amounting to $16.4million by the Goverment with it’s reputation being injured. The company was alleged of at least 93 deaths. Toyota’s chief executive, Akio Toyoda, in February had apologised to the Saylor’s family assuring that he would do his best to prevent future mishaps. However Toyota is continuing to defend itself against class-action lawsuits filed by Toyota owners and the relatives of the families affected.

However the investigation results by the National Highway Traffic Safety Administration’s incur from the vehicles’ on-board data recorders suggest otherwise. It is possible that in many of the cases the driver did not make use of the brakes and might have been mistakenly pressing hard on the accelerator.
